TERMS FOR USING OUR WEBSITE AND SERVICES

These Terms of Service govern use of the Nexus Flow One website and purchases of our website strategy, design, development, branding, search visibility, content, marketing, and related professional services. By using the website or purchasing a package, you agree to these terms and any written proposal, scope, or project agreement that applies.
Packages and scope
Package descriptions and prices are starting points for the stated service foundation. A purchase reserves project intake; it does not replace discovery or a written scope. Before production begins, we may confirm fit, deliverables, responsibilities, milestones, revisions, functionality, schedule, and additional charges. A written project agreement controls if it conflicts with these general terms.
Client responsibilities
You agree to provide accurate information, lawful content, required access, approvals, and consolidated feedback on time. You represent that you have the right to supply all materials provided to us. Delayed content, access, feedback, decisions, or payment may change the schedule.
Payments, fees, and taxes
Prices are shown in the currency presented at checkout. Payment timing is stated at checkout or in the project agreement. Taxes, transaction charges, third-party software, domains, hosting, apps, fonts, stock assets, advertising spend, and services outside scope are separate unless expressly included. Overdue amounts may pause work or delivery.
Changes and additional work
Requests outside the approved scope may require a change order, revised schedule, or additional fee. We will seek approval before performing material out-of-scope work.
Intellectual property
You retain ownership of materials you provide. After all applicable invoices are paid, you receive the rights to final custom deliverables described in the agreement. Nexus Flow One retains its pre-existing tools, methods, templates, processes, know-how, and reusable components. Third-party materials remain governed by their licenses. Drafts, unused concepts, and working files are excluded unless expressly stated. We will use your project publicly only with permission or as allowed by the project agreement.
Third-party platforms
Projects may rely on Shopify, hosting providers, registrars, apps, analytics, advertising platforms, artificial-intelligence tools, and other third parties. Their availability, pricing, policies, security, and functionality are outside our control. You are responsible for assigned third-party accounts and licenses.
Search and business results
We do not guarantee rankings, traffic, leads, sales, revenue, platform approval, advertising performance, or other business results. Outcomes depend on competition, demand, history, authority, implementation, budget, content, follow-up, and continued work.
Acceptable use
You may not use the website or services for unlawful, fraudulent, abusive, infringing, deceptive, malicious, or security-compromising activity; attempt unauthorized access; introduce harmful code; copy protected material improperly; or interfere with the website or other users.
Confidentiality
Each party will use reasonable care to protect non-public business, technical, and project information and use it only to perform or receive services, except when disclosure is authorized or legally required.
Suspension and termination
We may pause or terminate work for nonpayment, unlawful requests, abuse, security concerns, persistent failure to provide required materials or decisions, or material breach. Completed work, approved expenses, and non-cancellable commitments remain payable. Cancellation and refund eligibility are governed by the Refund and Cancellation Policy and any project agreement.
Disclaimers and liability
Except for obligations expressly stated in a written agreement, the website and services are provided on an “as available” basis to the maximum extent permitted by law. To that extent, Nexus Flow One is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, or business interruption. Aggregate liability relating to an engagement will not exceed the amount paid for the specific service giving rise to the claim during the six months before the event, except where law requires otherwise.
